Protection and processing of personal data

In connection with the implementation as of 25 May 2018 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR).

The company Brothers Władysław Bochniarz with its registered office at the address: Siedlce 141, 33-322 Korzenna, Tax Id. No. 734 143 73 97, hereby informs that from 25 May 2018, you will have the following rights with relation to the processing of your personal data.

We additionally inform that pursuant to Art. 13 of the GDPR, from 25 May 2018, the below information and terms concerning the processing of your personal data shall apply.

  1. The Controller of your personal data is Brothers Władysław Bochniarz with its registered office at the address:Siedlce 141, 33-322 Korzenna, hereinafter referred to as the Controller.
  2. The Controller has appointed a personal data processing officer, whom you can contact via email at the address: sekretariat@brothers.pl.
  3. Your personal data will be processed:
    1. for the purpose of sending you information and billing documents in relation to the services provided (hosting, marketing and other services),
    2. for the purpose of sending you informational and marketing content subject to your consent – legal basis for data processing: legitimate interests of the Controller (Art. 6(1)(f) of the GDPR); the legitimate interests of the Controller consist in sending you marketing content via email or traditional mail, in the course of providing services to you,
    3. for the purpose of complying with legal obligations of the Controller pursuant to the commonly applicable law, including tax and accounting regulations – legal basis for data processing: Art. 6(1)(c) of the GDPR,
    4. for analytical and statistical purposes – legal basis for data processing: legitimate interests of the Controller (Art. 6(1)(f) of the GDPR); the legitimate interests of the Controller consist in conducting analysis of the performance of their business,
    5. for the purpose of pursuing the legitimate interest of the Controller to establish or pursue potential claims or defend themselves against claims – legal basis for data processing: legitimate interests of the Controller (Art. 6(1)(f) of the GDPR).
  4. The recipients of your personal data may include:
    1. providers of IT systems, hosting and IT services,
    2. entities providing accounting, debt collection, legal, analytical and marketing services to the Controller,
    3. postal and courier service providers,
    4. electronic payment platform operators and banks – as required to process payments,
    5. authorities authorised to receive your personal data subject to the applicable law.
  5. The Controller shall not transfer your personal data to third countries.
  6. Your personal data will be processed:
    1. for personal data processed for the purpose of concluding and performing contracts of sale – for the period necessary to fulfil all obligations arising out of such contracts of sale,
    2. for personal data processed for the purpose of providing electronic services – for as long as such electronic services are provided to you,
    3. for personal data processed for the purpose of sending you marketing content by the Controller – until you object to such processing,
    4. for processing as specified in 3(d) above – for as long as such electronic services are provided to you,
    5. for processing as specified in 3(e) above – until the end of the period of limitation of claims. After the expiration of such periods, your personal data will only be processed in the scope and for the period required by the law, including accounting regulations.
  7. Your personal data will be subject to profiling.
  8. Every consent you give can be withdrawn at any time. Withdrawing consent to processing does not affect the lawfulness of processing prior to the withdrawal. For recordkeeping purposes, withdrawal of consent should be made in writing and delivered a) to the address Brothers Władysław Bochniarz, Siedlce 141, 33-322 Korzenna, or b) electronically to the email address sekretariat@brothers.pl.
  9. You have the right to access your personal data, rectify it, request erasure or limitation of processing, to lodge a complaint with a personal data protection supervisory authority.
  10. You have the right to data portability, which entitles you to obtain your personal data and transfer them to another controller, or to request, if technically feasible, that the Controller transfer such data directly to another controller.
  11. Providing personal data is voluntary, but it is necessary for the purpose of providing electronic services to you and concluding contracts of sale. Not providing personal data required by the Controller renders the provision of electronic services and concluding contracts of sale impossible.
